Terms of Service (ToS)
These Terms of Service, along with any additional terms and policies, apply to all services and products provided by Alex Varga (“Weblune”, “us”) and form the binding legal agreement between you (“you”, “Client”). These Terms of Service are collectively referred to as the “agreement” or “ToS.” All services offered by Weblune may be used only for lawful purposes. Before purchasing any service from Weblune, you must confirm that you have read, understood, and agreed to our Terms of Service. Weblune operates in compliance with the local laws of the countries in which it conducts business. By using our services, you acknowledge and accept these Terms of Service along with all related terms and policies.
The following documents constitute our additional terms and policies, which are incorporated into and considered part of these Terms of Service:
Account Setup / Registration
It is the Client’s responsibility to ensure that the provided email address is valid and kept up to date at all times. If there is an abuse-related issue or Weblune needs to contact the Client, the registered email address will be used for this purpose. Failure to maintain a valid email address constitutes a breach of these Terms, which may result in the immediate termination of your account.
Jurisdiction and Legal Responsibilities
The parties acknowledge that when Weblune acts solely as the Client’s host, it is not engaged in nor actively soliciting interstate or international commerce on behalf of the Client. If Weblune becomes a named party in any dispute or litigation involving the Client that affects out-of-state persons or entities, the Client agrees to indemnify and defend Weblune (including covering all legal costs) and to challenge the jurisdiction of out-of-state authorities over Weblune. Any legal disputes shall be governed by the laws of Nevis. Weblune is not responsible for any content or materials created, hosted, or accessed through its network or services that were not directly provided by Weblune.
Availability and Backups
Weblune stores client websites, files, emails, and databases on its servers. The parties acknowledge that internet servers and connections are subject to downtime, crashes, and vulnerabilities, and Weblune may periodically perform maintenance. Clients using unmanaged services are responsible for maintaining their own backups at their own expense. Weblune is not liable for any data loss caused by system failures, downtime, or vulnerabilities. Additionally, Weblune will not provide backups for services containing materials that violate the Acceptable Use Policy. Due to the nature of computer hardware, Weblune accepts no liability for any data loss.
Maintenance
Weblune may temporarily suspend services for maintenance, repairs, or system improvements as necessary to ensure service quality. Weblune will provide at least 24 hours’ notice for scheduled maintenance. Emergency maintenance may occur at any time, with or without prior notice. Invalid rDNS records may be removed at Weblune’s discretion. Clients must ensure their services do not become blacklisted, banned, or blocked by any firewall or blacklist. Weblune cannot provide replacement IP addresses for issues arising from client negligence.
Security
The parties acknowledge that flawless security cannot be guaranteed. The Client is solely responsible for securing their hosting account, including updating passwords and applying necessary security patches over time. The Client is fully liable for any damages resulting from unauthorized access and agrees to indemnify Weblune against any losses resulting from such incidents. Clients must keep passwords secure and not disclose them to third parties. Any security breach or unauthorized account use must be reported to Weblune immediately.
Refunds
All sales are final. No refunds will be issued under any circumstances.
Copyright & Abuse
All abuse reports must be submitted in the proper form. You may report abuse through our Ticket System or by emailing abuse@Weblune.net. Reports must include a clear description of the abuse, supporting evidence, and the sender’s contact information.
Upon receiving a valid abuse report, Weblune will forward it to the Client by email and suspend the associated service. The Client must respond within forty-eight (48) hours. Failure to respond within this timeframe will result in account termination without refund.
Weblune is not responsible for copyright violations related to content hosted by the Client. Weblune enforces a zero-tolerance policy toward illegal activity and spam. Hosting content such as child exploitation material, terrorist propaganda, or any other illegal content is strictly prohibited and will result in immediate account termination.
Payment Information
Weblune accepts cryptocurrency payments including Bitcoin, Lightning, Litecoin, and Monero, processed via our self-hosted payment gateways without third-party intermediaries. All services are prepaid. Renewal invoices are sent 14 days before the due date. If payment is not received by the due date, the service and all associated data will be deleted. Weblune will not activate new orders or services for Clients with outstanding balances. A zero (0.00 EUR) balance is required for new service activation unless otherwise stated by Weblune in writing.
Resource Utilization
If Weblune determines that an account is consuming an excessive amount of system resources, it may temporarily suspend the account. In extreme cases, the Client may receive a five (5) day notice to transfer to another provider. Clients on shared hosting are not permitted to run background processes, as they consume excessive resources and may impact other users.
Mass mailing of any kind, including unsolicited (spam) or solicited bulk messages, is strictly prohibited. Using spam to advertise a website hosted on Weblune also constitutes a violation of these Terms.
Domain Name Services
Domain names registered through Weblune are held under Weblune’s name on behalf of the Client. The Client retains ownership rights and control over each registered domain, including the right to transfer, renew, or sell it. The Client is responsible for resolving any financial or legal claims associated with their domains. Weblune does not guarantee domain availability even if a search indicates otherwise. Domain fees may change at any time. Our system cannot detect premium domains and will display them as available; if a premium domain purchase is attempted, Weblune reserves the right to cancel the order and credit the paid amount to the Client’s account. Premium domain purchases may be processed upon receipt of full payment. Weblune will not process or maintain domains used for phishing, copyright or trademark violations, or any prohibited activities under our Terms or Acceptable Use Policy. Such domains will be cancelled, and refunds will be issued as account credits. Domains found to be used for phishing may be suspended immediately.
Order Processing
Shared Hosting and VPS Servers are automatically deployed after successful payment. Dedicated Server setups may take up to 48 hours.
Domain name orders are manually reviewed and processed within 24 hours to ensure fraud prevention. Unpaid orders older than 24 hours may be removed from the system.
Support
All Weblune services are unmanaged unless otherwise stated on the product page. Support tickets are generally answered within 24 hours. Sales-related inquiries may take longer to process. Existing customers and active services are prioritized over new inquiries.
Final Note
Failure by either Weblune or the Client to enforce any part of this Agreement shall not constitute a waiver of any rights or provisions herein. If any section of this Agreement is found invalid or unenforceable, the remaining provisions will remain in effect. This Agreement may be executed in multiple counterparts, each considered an original but together forming a single agreement. Weblune reserves the right to modify or update these Terms at any time. If you do not agree with the updated Terms, you must discontinue using our services. Continued use of our website and services indicates your acceptance of the updated Terms of Service.
